Terms and Conditions

Last updated: 30 May 2026. This is a baseline agreement provided for transparency; please have it reviewed by legal counsel before relying on it.

These Terms of Service (“Terms”) govern your use of the MailCraft.eu email marketing platform and website operated by Web Systems Krzysztof Balicki (“MailCraft”, “we”, “us”). By creating an account or using the service, you agree to these Terms.

1. Definitions

Service – the MailCraft.eu platform, website and related services. Customer / you – the person or business with an account. Subscriber – a recipient on the customer’s mailing lists.

2. Account & eligibility

You must provide accurate registration information and are responsible for activity under your account and for keeping your credentials secure. Accounts are for business use; you must be at least 18 and able to enter into a contract.

3. Plans, billing & currency

• Plans are billed monthly or yearly in advance. Prices on the pricing page are in PLN and are net amounts; VAT is added where applicable (23% for Polish customers; reverse-charge for valid EU VAT IDs).
• Invoices are issued via Fakturownia and reported to KSeF as required by Polish law.
• Subscriptions renew automatically unless cancelled before the renewal date.

4. 14-day money-back guarantee

New customers may request a full refund of their first payment within 14 days of the initial purchase, no questions asked. To request a refund, email support@mailcraft.eu within the 14-day window. This does not affect any statutory withdrawal rights you may have under Polish or EU consumer law.

5. Acceptable use & anti-spam

You may only send email to recipients who have consented to receive it. Purchased or scraped lists, spam, phishing, malware, and illegal content are strictly prohibited. We use double opt-in and honour unsubscribe requests. We may suspend accounts that harm deliverability or violate this section or applicable law (including GDPR and anti-spam rules).

6. Customer data & data processing

You retain ownership of your subscriber data. We process it as your data processor solely to provide the service, in line with our Privacy Policy and baseline Data Processing Agreement. Data is hosted within the EU.

7. Service level (Business plan)

For customers on the Business plan, we target 99.9% monthly uptime for the application, priority support with same-business-day first response, and dedicated sending infrastructure with managed IP warmup. Planned maintenance is announced in advance and excluded from uptime calculations. Specific SLA commitments and any service credits are set out in the Business plan agreement available at sales@mailcraft.eu.

8. Suspension & termination

You may cancel at any time from your account; access continues until the end of the paid period. We may suspend or terminate accounts for breach of these Terms, non-payment, or unlawful use, with notice where practicable.

9. Liability

The service is provided “as is”. To the extent permitted by law, our aggregate liability is limited to the fees paid in the 12 months preceding the claim. We are not liable for indirect or consequential damages. Nothing limits liability that cannot be excluded by law.

10. Governing law & jurisdiction

These Terms are governed by Polish law. Disputes are subject to the competent courts of Poland, without prejudice to mandatory consumer-protection rules.

11. Changes

We may update these Terms; material changes will be communicated via the website or email. Continued use after changes take effect constitutes acceptance.
