1. Agreement to Terms
By accessing or using MailCraft services at www.mailcraft.eu and app.mailcraft.eu, you agree to be bound by these Terms and Conditions. If you do not agree, you may not use our services.
2. Description of Services
MailCraft provides an email marketing platform that enables users to create, send, and manage email campaigns, subscriber lists, and automated email sequences. The specific features available to you depend on your subscription plan.
3. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration and keep it up to date.
4. Acceptable Use
You agree not to use MailCraft to send unsolicited bulk emails (spam), transmit malicious content, violate any applicable laws (including GDPR and CAN-SPAM), infringe on intellectual property rights, or send emails to purchased or scraped email lists without proper consent.
5. Subscriber Data
You retain ownership of all subscriber data you upload to MailCraft. You are responsible for ensuring that you have proper consent to collect and use subscriber data in compliance with applicable data protection laws. MailCraft acts as a data processor on your behalf.
6. Payment and Billing
Paid plans are billed on a monthly or annual basis as selected during signup. Prices are subject to change with 30 days’ prior notice. Refunds are not provided for partial billing periods unless required by applicable law.
7. Service Availability
We strive to maintain high availability of our services but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance when possible. We are not liable for any losses resulting from temporary service interruptions.
8. Intellectual Property
The MailCraft platform, including its design, code, and documentation, is the intellectual property of MailCraft. You may not copy, modify, distribute, or reverse-engineer any part of the platform. Your content and subscriber data remain your property.
9. Termination
Either party may terminate the agreement at any time. We reserve the right to suspend or terminate accounts that violate these terms. Upon termination, your data will be retained for 30 days, after which it will be permanently deleted.
10. Limitation of Liability
To the maximum extent permitted by law, MailCraft shall not be liable for any indirect, incidental, or consequential damages arising from your use of the services. Our total liability shall not exceed the amount you have paid for the services in the 12 months preceding the claim.
11. Governing Law
These terms are governed by the laws of Poland. Any disputes shall be resolved in the competent courts of Warsaw, Poland.
